The “Where’s The Fair Use” movement has been going pretty strong this past week. I wanted to share some examples of copyright fights my channel has fought in the past and want to tell you not to be afraid for your own channels or to step up and fight to defend them. Also features examples of Fair Use under my friend Cosmeticqt’s channel. Keep fighting! Don’t be scared! You can still do what you love!

As someone who posts videos, I can confirm that YouTube’s ContentID system is bullshit. Like Marzgurl says, it doesn’t take into consideration context, so one of my Smash Wii U videos was flagged because the song that played in the background of the fight was Super Mario Galaxy’s theme.

The way Nintendo is playing the ContentID game, any video that contains footage from any game they include in their Creators Program is forced to be monetized - for Nintendo. This includes both Mario Galaxy games, but if you look at their whitelist very carefully, you’ll see 5 high-profile Nintendo games absent from that list. The entire Super Smash Bros. series is not in that list, meaning any monetization is supposed to go to the user.

Okay, no problem. File a dispute and get the claim lifted. Shouldn’t take but a day or two, right?

HAAHAHAHAHAno.

@nintendo falsely flagged two of my Smash videos (they’re not publicly viewable right now), one on the Super Mario Galaxy stage and another on the Pirate Ship stage because it played the completely unremixed Dragon Roost Island theme from Wind Waker. I disputed both, but Nintendo only released the Pirate Ship fight claim. They rejected the dispute on the Mario Galaxy fight video.

Okay, appeal the rejection because YouTube allows me to. Fine. Whatever.

From what I can tell, Nintendo is determined to run the clock out on my appeal. They are forcing me to hold the video back for as much time as they can get away with in the vain hope that they can collect as much money on that video as possible. Joke’s on them, because I uploaded it as a private video, so the only one who can see it is me.

…and them, if they ever get off their ass and actually look at the fucking thing. I just don’t think they give two shits about poor widdle ol’ me.

And no, I’m not bitter. Just correct. …and also bitter.
